Copyright and DMCA
This page explains the copyright processes on Podbul, and the steps for notification of infringement, assessment, and takedown requests under the DMCA. The aim is to ensure a transparent and balanced operation between rights holders and content providers. This content is for informational purposes.
Scope and Definitions
Podbul complies with applicable copyright legislation and, to the extent applicable, DMCA principles. The concept of “copyright” includes exclusive rights to original works, images, sound recordings, texts, software and similar content. “Notice of infringement” is when the right owner or authorized agent identifies unauthorized use and submits a formal complaint. A “takedown request” aims to temporarily or permanently remove the infringement arising from the content.
Podbul, as an impartial intermediary, reviews applications, notifies the content provider when necessary, and implements appropriate procedures. License, authorization and fair use/exception claims are carefully evaluated in notifications. Counter-notification processes are operated according to the applicable legislation and platform policies.
- Right holder The person/organization with copyright over the work
- Authorized representative: The person/organization authorized to carry out transactions on behalf of the right holder
- Content provider: The user who uploaded or published the relevant content
How to Report a Breach
Notification of infringement must be submitted via the Copyright & DMCA form in your account. In your notification, you must provide clear, verifiable and complete information and documents that form the basis of your claim. Submissions that do not contain sufficient information may be returned with a request for additional documents without action. Misrepresentation and abuse may result in account measures.
- Description and original source of the allegedly infringed work
- URLs or unique identifiers of allegedly infringing content on Podbul
- Explanation of your entitlement or authorization status
- Evidence of license or authorization agreement, if any
- Your contact details (name, institution, e-mail, country/city)
- Declaration of good faith and truthfulness/authorization
- Wet/digital signature or equivalent authorization confirmation
When submitting a takedown request, clearly specifying the scope will speed up the process. For example, a narrowed scope, such as a specific section, image or set of works, is preferable. A single infringement notice can be sent for multiple items, but the identifying information for each item must be clearly attached. In cases of immediate risk or repeated violations, prioritization can be based on the content of the notification and the sufficiency of evidence.
Evaluation Process and Response Times
When the application is received, the preliminary examination starts with identity/authorization verification and scope control. For eligible applications, the relevant content provider is informed and temporary access restrictions may be imposed when deemed necessary. If there are allegations of license, fair use/exception or false matching, the statements and evidence of the parties are evaluated together. In case of disputes, the counter-notification process is carried out to the extent permitted by the legislation.
| Phase | What to do | Target time |
|---|---|---|
| Preliminary review | Notification format check, basic validations | 24-48 hours |
| Content notification | Transmission to the content provider and interim measure assessment | 1-3 working days |
| Substantive review | Evaluation of evidence, scope clarification | 3-7 working days |
| Result/process | Decision to remove, restrict, restore or refuse | Variable according to file status |
Target times may vary depending on the volume of applications and sufficiency of evidence. When a decision is made, the applicant and the relevant user are notified. When a counter-notification is received, a certain period of time may be waited in accordance with the legislation and the content may be restored unless official proof that legal proceedings have been initiated is provided. Personal data and trade secrets are processed only to the extent necessary and in accordance with applicable law.
Contact and Forms
You are expected to use the Copyright & DMCA form within the platform for all copyright, DMCA and takedown request processes. The form fields collect the information required for the infringement notification step-by-step and ensure that your application can be tracked. In cases requiring official correspondence, the parties will be contacted through the communication channels provided during the application. Applications can be submitted in Turkish or English.
- Re-verify URLs and file IDs before submitting the form
- Attach legible copies of license or authorization documents
- Group similar content in a single request, listing each item separately
- Complete the declarations of good faith and truthfulness
- Check your notifications regularly in case of counter-notifications
